Common Law Marriage
I have lived with a fellow for 6 years, he left in May for a visit in his Home State of Maryland, all the while he told me he was coming back leading me to believe he would return with my 2003 Kia Rio then he quit paying for the car and it has been reposessed. He didn't return and started living with another woman. I supported him for the 6 year term that we lived together, most of the time he only had min. wage employment while he lived with me. He now says he plans to marry the woman. Now my question is this can I file for divorce and get alomony from him plus and or damages for my credit being ruined because of the reposession? We filed all of our tax returns together as married filing jointly. Thank You--name removed--Fredrich

With documentation of your tax returns to support your contention, you can probably establish a common law marriage, and require a divorce to terminate the marriage. You were not married long enough to qualify for permanent spousal support, but might be entitled to temporary spousal support. You need an equitable division of assets and debts. Caution: he will also be entited to an equitable distribution of assets and debts. On car loans, insurance, etc did you list yourselves as married?
