Common Law Marriage

I am in a common law marriage and have been for 7 years. I have two children also in this from a previous marriage. I have found that my partner has been unfaithful for quite some time. Now that he has been exposed he is threatening to kick me and my two children out on the street. Can he legally do this?

You need to file for divorce to establish your rights to your share of the marital estate. A judge will not kick out a spouse to the marriage without a hearing.
