am I married if I file A joint tax return and A bank account

It is quite simple to meet the qulifications of common law marriage. First, you agree to consider yourselves married. Second, you both cohabitate together. Note that I did not place a length of time on this cohabitation. Finally, you must hold yourselves out as married. Thus, by filing taxes as a married couple or establishing a joint bank account, you provide evidence of a common law marriage. Once married, a divorce may be necessary to dissolve the marriage.
