First, don't assume it's a common law partner. That's a particular legal conclusion that must be made by a court OR you have to have filed a declaration of informal marriage.

If your partner is not really a "common law" spouse, then the test is whether your partner has a lease. If he or she has been paying rent or is on the lease, you will have to evict him or her. If he or she is just shacked up with you, you can just change the locks.
