Commonlaw Marriage
Since I lived with my commonlaw spouse for several years, we had children together, and filed one tax return together do I have to file for divorce since we have separated or am I legally single?

Without a few more details it's hard to be positive, but you're probably married and should get a divorce. You should talk to a good family law attorney.
