community property

My husband has 2 children by a previous marriage and I have a 2 children by a previous marriage. We have no children together. We own property together. In the event of death of one of us, how will the property be divided?

Well, if the two of you draw up wills, your estates will be divided according to the provisions of your wills. Otherwise your estates will follow the rules of intestate distribution - which is the case when a person dies without a will. Then the statutory rules will determine how the property is distributed to the decedent's heirs. The other spouse's children would have no inheritance rights unless the decedent had adopted them prior to his/her death or provided for them in his/her will.
