What are the rules concerning community property when one spouse is unaware of a settlement of a loan where stock certificates were issued to the other spouse.

I guess I'm a little unclear on your question. The rule in Texas is that any property possessed during marriage or on divorce is community property unless one of the spouses can show otherwise by clear and convincing evidence. If these stocks were acquired during marriage, then it is likely that they are community property.
