Legal Question in Family Law in Texas

Conflict of Interest?

We have been fighting a custody case since 2001; I have always been the nonprimary/possessory conservator. I discovered recently (this week) that my child's father's wife had a DWI trial case dismissed in 1998. Her attorney was, the now present judge presiding our case. Wouldn't this be a conflict of interest? Granted I'm not blaming their past realationships on any failure of the case, but who is to say? What would normally happens in this situation? Thank you.

Re: Conflict of Interest?

The judge may not even recall the connection. Your attorney can file a motion asking the judge to recuse himself/herself based upon the prior relationship.
