constructive custody

I have custody of my 16 year old daughter, she was a good student, but about a year ago, she starts hanging around gangs, drugs, not attending school, running away, the police reports did not stop her, so now she want to go live with her dad, so that way she can do what she wants, he has no rules and no consecuenses, I know that if my daughter want to live with, she can but I also need that I need to help her get back on track. What can I do. at this time she states that she does not need me and that she has a new mom and to stay out of ther life, what can i do?

Although she has a choice, a modification would still have to be made and the test is still "best interest of the child". Sounds like you may have a small chance of saving her if she stays with you -- if you want to do that. This is a fairly simple legal question, but an extremely complex social question on which I am not qualified to make an opinion. Good Luck
