Legal Question in Family Law in Texas

i want to get a contested divorce, but my question is what are my right as a mother and the apartment ive paid for the last 4-5 months because my husband hasnt had a job or get on medication. hes bipolar im bipolar, but i take medicine.

If both of your names are on the lease, you are going to have to negotiate this issue. The court will probably think about it this way, for the pendancy of the case:

1. The kids get to stay in their home (the apartment)

2. The parent who is the primary caregiver gets to stay in the home with the kids.

3. The other parent may have to move out and start paying temporary child support. (If that is yoru husband, he will have to find a job and start supporting his children.)
