Legal Question in Family Law in Texas

contesting adult guardianship

I am 49 years old. I was declared incapacitated (not incompetent) in probate court in Indiana in 08/08. I did not agree to it, but the court granted full guardianship of me to my brother. I left the state of Indiana and now reside full time in Texas. My brother is unwilling to give up guardianship and is withholing my social security benefits unless I move back to Indiana. How do I go about getting this guardianship over me rescinded?

Re: contesting adult guardianship

I am not licensed in Indiana and know nothing about Indiana law but my guess is that this will have to be addressed in the original court in Indiana. I suggest you reask your question and aim it at Indiana attorneys. Also, at least in Texas, this is not really the correct category for this question, so try posting it to the Wills and Probate category.
