is it illegal to tape record a conversation without the other persons knowledge?

No -- it is not illegal in Texas to tape record a conversation, if at least one party to the conversation has knowledge of the tape recording.

No recording conversations between the kids and the other parent (or anyone else)! Even if the kids know they are being recorded, they are children and can't give consent.
