Co-parenting rights, extortion, welfare fraud
Lesbian couple has baby via donor center. Baby is born
Birth certificate (of course) states no father, BUT child holds the last names of both parents.
The non-bio mother is the sole support of the child for 4.5 years (current age of child) but the couple broke up at child age 2yrs & bio mom took custody of child collecting welfare & child support (demanding it in cash form) from the non-bio parent. The non bio parent has (at bio moms threats & demands) supported money for housing, new vehicle, all clothing, entertainment, gifts, etc. Bio mom takes none of this out of child support monies provided each month.
Non-bio mom recently demanded that all child support payments be paid via check...no more cash, & requested legal co-parenting rights w/child support to be regulated through a court system. Also gave a 6 mo. heads up that bio mom find herself a vehicle of her own.
Bio Mom gets angry, returns vehicle & refuses to cash check (prob because proof of welfare fraud) for child support & refuses any rights to child, jerking child from non bio moms life.
Bio Mom has extorted money from non bio parent for years & threatens when does not get it-extortion?
What chance does non bio parent have to getting co-parenting rights to child?

Unfortunately, if the child hasn't actually lived with you for at least 6 months within the last 90 days probably not all that great. You really need to talk to a good family law attorney who has handled this type of case before. Good luck!
