Legal Question in Family Law in Texas

In Different Counties

Wife, children, and I no longer reside in Harris county and have not resided there in 3 years. Our case (involving our 2 oldest children and their biological father who lives in NJ) was closed out last year. It needs to be reopened/modified. Since we no longer live in Harris, can it be reopened/modified in Montgomery? Thank You.

Because Harris County is where the court of continuing jurisdiction is located, any new filing must take place in Harris County. However transfer to Montgomery County is mandatory if a timely filed Motion to Transfer is filed at the time of the initial filing in Harris County. In other words, you can get the case to Montgomery County, but it must be initially filed in Harris County.
