Legal Question in Family Law in Texas

What county do I look for a lawyer in?

My wife and I live in Houston, TX and want to get a lawyer to try and get custody of my 8-year-old daughter. She lives with her mother in Andrews, TX. The divorce was filed in Houston. Is it true that we have to get a lawyer from the county in which they live in?

Re: What county do I look for a lawyer in?

The Houston court has juridiction of the case, so the modification will be filed there. HOWEVER, her lawyer will immediately file to transfer the case to the county where the child has resided more than six months. Absent some properly filed, verified, compelling reason, the court will tranfer it.

So you will need a lawyer to file it in Houston, then be prepared to get a lawyer in Andrews. When you first meet with the Houston lawyer, explain the situation carefully, so he/she can get you a referral prepared to go forward in the new court.
