Legal Question in Family Law in Texas
Not following court order
I believe my daughters father isn't following the court order in putting me down as a contact person when he takes her to the Drs and daycare. Last yr while at his home she went to daycare, we went in a week prior to her attending so we could meet the teachers. I gave them a copy of my license. They told me I could call when ever I wanted. 3 weeks later (after I've called once and spoken to them) they tell me they aren't allowed to speak to me until they can verify who I was. He accused me of going to the school to pick her up, when I never did, so brought the court order in to show them he had custody of her that month. Comments they made, gave me the conclusion I was not on the emergency contact list, even though in the court order I am to be. Also she was injured at his house and he had to take her to the Dr. I called to get the records, and after learning who I was they refused to speak to me, even after I told them about the court order and told them I could fax it to them or bring it to them. Theres other instances where I believe he isn't following the order, but when I ask him he lies (thats why I had to call the school and Dr, because I wanted to verify the info he gave me). Not sure what I can do:(

Re: Not following court order
When a person does not follow a court order, you have to file a motion to enforce. If the order is not clear, then you can file a motion to clarity. If the person still does not follow the court order, you can file a motion for contempt. For the Dr.'s office and school personnel who would not discuss your child's case with you, subpoena them for a deposition or to testify in a court hearing. Just a few of those and they will get the message who you are. Unfortunately, this will cost you some money. But you can seek attorneys fees. I don't know whether you would get them or not. Depends on how good your attorney is. Good Luck.
