Legal Question in Family Law in Texas
Court Ordered Drug Test
My ex-husband was ordered by the court to drug test and provide a hair sample to the probation department. He filed a motion for me to test also. I agreed and provided a hair sample, like within an hour after the court hearing. I told the Probation Officers at the probation department that my ex-husband's hair was long, like 5-6 inches past his ears, just in case he cut his hair. Well, he cut his hair, like within 4 hours after our court hearing that morning. He cut his hair to less than 1 inch, very short. When the probation officer told him to submit a body hair sample he left the building and went to his attorney's office to discuss the situation with his lawyer. He was advised he needed to return to the probation department and submit a body hair sample. He did go back and submit the body hair sample. I heard body hair sample is different than an actually head hair sample. We have an 8 year old son and his father has supervised visitation not the standard possession order. Why did his attorney advise him to go back and test?

Re: Court Ordered Drug Test
Not being a mindreader, I don't know why his lawyer told him to go back. If it had been my client, I would have advised him that the judge would already be irritated with the hair cut, and to refuse a body sample would likely result in a direct contempt of court and some time in a jail cell.
