Legal Question in Family Law in Texas
Court Ordered Re-imbursement of Medical / Dental Expenses
My wife's ex has primary custody of her 13 y/o son. She pays child support, and is required to pay 1/2 of any non-covered medical expenses. Her ex is required to pay for his insurance. We have no issue with paying our share of the costs. The refuse to send us receipts as required in the order (most of the time), and have sent us fraudulent receipts that were sometimes 3x the actual expense, or were completely fabricated. We have the actual documentation from the physicians billing records that show the true amounts paid. They also told us that his insurance was cancelled to inflate the amounts they were trying to collect. We overpaid what was owed based on the info provided to us, and then subsequently found that we had been duped. What recourse do we have? He say's we currently owe them for some bills, but have no receipts that we can depend on. We want to pay our share we just don't know what it is.

Re: Court Ordered Re-imbursement of Medical / Dental Expenses
Your wife needs to contact the medical providers directly, and make arrangements for duplicate bills to be mailed to her, so that she can identify the correct amounts owed.
She can then prepare an itemized accounting showing how much was owed under the decree, and how much was paid. If she has overpaid, she can deduct from future medical expenses. I would suggest to you that the money is gone, and this is an issue that can turn a battle into a war. Considering the cost of litigation, it would be smarter to just pay the correct amounts going forward, and forgive the overpayment in the past.
