Legal Question in Family Law in Texas

no court orders and paper that says i have to stay in texas moved here 1 year 5 months and have been trying to go back to vermont where my home is. and i have 3 kids one of whom the father does not live here. my youngest children are from the man i am living with. been told i would be charged with kiddanpping if i left he has know where and when and why i want to be home not only for me but my kids my children were set up in head start and all programes i used to my advantage my kids were set up. i have everthing setup for us to go back but am really not sure what to do i feel i have been kidnapped my self not only my kids. the is a statues that states it is in the childs best interest to be around family and sibbs. my family and his family are in vt but his mom and dad and grandma. i dont see myself here things just arnt working for me here in texas like they were in vermont. can i go safly or will i get charged?
