Legal Question in Family Law in Texas

In our court papers it states the custodial parent must pick up the child from the non custodial parents residence on the sunday of the weekend visitation. we live in different towns so if the custodial parent fails to pick up the child who is held responsible if the child misses school?

If the custodial parent fails to pick the child up, a good noncustodial parent would take the children to school the next day...even if it meant a long drive. Make note of the incident and perhaps with enough of these incidents you will have ammunition to sustain a motion to modify conservatorship.

Your question was who is responsible? Both parents are responsible for their children under the law, but the custodial parent would probably get 5% more of the stink-eye if it came down to partitioning blame.
