Coustody when one parent moving out of state

My wife and I are moving out of state. She has governing coustody of 6yro son.

Father my be trying to get coustody.

In they're divorce he was charged with assulting her.

We both have good jobs and provide a stable household for the child.

They move is to provide better schools and soical enviroment for the child.

What our are chances of coustody being reversed to the father?

Slow down. Does her decree have a geographical residency restriction? Most decrees in the past 10 years contain such a provision.

How old is the assault? Did it involve the child as a victim or witness?

Generally speaking, when a modification is sought, the judge has little interest in behavior that predates the most recent court order on the subject.

The judge will look at the totality of the circumstances, and is bound by the code to make a decision in the best interest of the child.
