Legal Question in Family Law in Texas
CPS took my brothers kids, he willing gave children to me about a month ago and since then they have been with me and my fiance.Most likely they will terminate there rights and i am looing to adopt. I have recently hired a lawyer to help me keep custody of the children and if so i will be adopting them. We went to court yesterday to let court know about my intervention and they reschedule court for Sep.11 but CPS wants the child until they do a home visit to my place to make sure it is baby safe. i volunteered to drop him off so i can say goodbye for now ( was the hardest thing to say goodbye) because my lawyer says we had to cooperate and let them do what they have to do as far as doing a home visit. My question is does CPS have to do the home visit before the next court date and how long would it take to get child in home back with me :( also they will not allow me to vist child while he is in there care because i am not the parent does that sound right :( because i am family (aunt) and i really want to see him for his 1st birthday friday... i feel so lost that he not with me i just want any advice i can get

You are paying good money to an attorney, I would think because you trust their judgment, expertise and ability. Don't second-guess him/her now. Ask these questions. They are fair questions, and your lawyer may be able to resolve some of the issues; or explain why not. I can understand that you are frustrated and sad, but it sounds as if you have done a wonderful thing for these children, and your attorney is successfully representing you. Good luck.
