Legal Question in Family Law in Texas
CPS and Drug Screening.
I have been having a horrible time with my ex stalking and harrassing me. I finally decided to go to the police and the help they gave was a call to him which only made him more angry. I let the detective know that this would happen. Within two days of the police cantacting him he called CPS with a lot of bogus aligations. CPS visited my 10 yr old son at school and then set up an appointment time to meet with my roommate and myself along with her 3 yr old son. They found absolutely nothing wrong with the children or the home, but are trying to demand that we take a drug screening. They are only enabling him to continue to torment myself and my family. Therefore I have refused the screening and see no reason for them to persue any further. Please help me to understand my rights. Surely there is something to be done. There are so many families that need for CPS to step. I do not understand why precious time and money are wasted on calls that have no evidience of any neglect or misconduct with the children or within the home. Please help.

I'd immediately retain an attorney.
If you refuse to take the drug test, CPS may decide to remove your children.

I would never disagree with Ms. Brochstein. She knows her stuff. Her advice about retaining an attorney is right on. If you don't want to take the drug test because of your feelings, then you better get ready to contest the forthcoming vengeance of CPS. They are little dictators who feel they don't have to follow rules. If you feel strongly about this, hire an attorney, but you will go to the top of the list for revenge by CPS.
