the hospital called CPS because I
went to the ER with my infant and
then the intake nurse said she
seemed fine so left. Because I did
not see the doctor CPS was called.
They asked me questions and
asked me to take her to their
doctor the next day to ensure she
was ok. I did that and I called the
CPS worker and she said that
everything checked out, the baby is
fine, and the case will be closed.
But she asked me because I
answered her questions honestly
about ever using drugs, which was
over 6 years ago, if I would submit
to a drug test. Do I have to since
the case was bogus and a mistake
by the hospital.

No, you don't; but tread lightly here, as CPS has a great deal of ex parte power. Even in court, CPS tends to react, and clean up their messes afterwards. Consider having an attorney on standby in the event someone at CPS overreacts. Be polite, but firm.
