CPS and an interview with my child

My ex-husband and his girlfriend have accusations against them for verbal and physical abuse with my son and with her daughter. I am his Custodial Parent and I have been informed by my ex-husbands gf that an interview is going to take place in their home, as well as pictures being taken and observation of the interaction between her and my son, and I cannot be present. I wanted to know if CPS had to inform me of the interview, the observation and the pictures being taken of my son and why it is being held in the house of the accused instead of it being held somewhere else? What are my rights as the custodial parent and what can I do to prevent it from happening in the accused household and for me to be present while all of this is going on? I know that I cannot be present during the interview, but I believe that the interview doesnt need to take place because my son is only 3 years old. Please Help!!!!!

I agree with Ms. Bushman, and want to add that if your child is being physically abused in his dad's home, you can file a Petition to Modify, asking for restricted and/or supervised visitation.

Everything that involves CPS is complicated and inconsistent, but why are you getting your information from the girlfriend? Have you asked the case worker or supervisor if you can be present at the interview? Have you asked the case worker or supervisor why it is being done in the home and not at an assessment center?
