if cps have no proof at all to take my newborn son away from me, were they really able to?

If they have evidence that your son is in danger, they have a lot (some say too much) power to start removal proceedings. However, they probably didn't take your son away. They probably intimidated you into signing papers where you gave him up "voluntarily." You're going to need an attorney who handles CPS cases or they will bulldoze you.
