Legal Question in Family Law in Texas
Current divorce decree has my son living with me but he won�t be for his last year of high school (decided he wanted to live with his mother). We have an agreement under the table of course that I will send her court ordered child support back to her with an amount I kick in to make things fair. My question is this � if she decides she doesn�t like the arrangement after he graduates high school (June 2010) would she be able to ask for a modification and see back child support for the time he lived with her? I would think a judge would look at this and ask why an order that is no longer standing would be changed, after the fact. Is there a statue of limitations on something like this? I realize it�s convoluted and she also owes me over 10K in back support but I don�t trust her to eve hold up to her end of the bargain.

If you don't trust her then maybe you shouldn't do an "under the table" deal with her. You need to talk to a good family law attorney. There are ways to do this to protect yourself.
