Legal Question in Family Law in Texas

Current spouses financial info given to ex for child support change

I've been divorced for 10 years with 2 children by that marriage. Ex wife going back to court to get child support amount increased. Current wife is employed, receives child support and claims her 2 children on income tax returns. 2005 taxes filed jointly with current wife who does not want ex to see any of her financial info. Ex's attorney wants to see my (our)2005 tax return. What are my options as far as excluding my current wifes income? J

Her income is not counted for child support. Your attorney could object to the request and provide your w-2's only.

Yes, you can do that but many people have additional income that does not appear on only W-2's.

I'd be prepared to produce the tax returns.

Of course, I'd first had opposing counsel a copy with her income amounts blacked out.

Keep copies without any amounts blacked out just in case the judge does not agree with your position.
