Legal Question in Family Law in Texas

Custodial parent grants power of attorney

My sister in law would like for me to keep her child from a previous marriage for a while. The child is 12 and I would need to enroll her in school. My sister in law is the custodial parent and the father lives out of state and has little contact. Is it OK for just the mother to sign a power of attorney or do I need to have permission from the father as well?

Normally the schools require you to have custody in order to enroll a child. That requires a legal document signed by a Judge.

You should contact the school district and find out what they require.

The piece of paper the mother might sign has not legally binding on her or anyone else. In other words -- it's worth the paper it's written on!

Good luck!
