custodial parent in jail

what are her rights as far as were her kids go? does she have the right to send them somewhere else then to their dads until he files an emergency modification. what happens when she makes bail?

I'm sorry, based on your limited information I can't figure out what you are asking.

Dad needs to immediately file an emergency modification.

I assume that there are some court orders in effect. Therefore, if primary parent is in jail, then the other parent is the next in line to get custody of the children.

If you don't have an attorney, I highly recommend Patricia Bushman. She's reasonably priced and does a lot of complex family law cases. Please tell her that I sent you to her!
