Legal Question in Family Law in Texas

custodial parent

I am unmarried and have a 1 week old my baby's daddy wants the baby to sleep over his house half the time without me what is the texas law regarding visitiation and custodial parenting with regard to infants?

You need to get in and visit with an attorney immediately. I know of no judge which will order you to turn over a one week old baby for visitation. I cannot even tell from the facts which you provided whether a formal parent-child relationship has been established between the father and the child. Since the two of you are not married, some formal action needs to take place before that relationship is legally established. Simply putting his name on the birth certificate does not necessarily establish this legal relationship. There is no law that says he can or he can't. It's whatever you want to agree to - if you don't have an order of the court. Your next request might be - how do I get my baby back? I suggest you wait until you get a court order. Good Luck.
