Custodial rights on non-birth father

My sister in law lives in tx and adopted a baby through an agency. The birth mother was married but had she became pregnant through an affair. Both birth mother and father gave up their rights to the child to the adoption agency. The baby is 6 months old and my sister in law has had the baby for a week. Now the birth mother's husband is wanting custody of the child. The child has lived with the birth mother and her husband for the 6 months before she was kicked out of their house. Does he(birth father) have any legal custodial rights to the child if there is not any legal paperwork giving him custody?
