Custody, affair, and emotional abuse

I had a short affair, there are a lot of e-mails, some steamy some not, between he and I on my company server. The affair never took place around the kids. My husbands emotional, and mental abuse towards me lead me to this. If I sue for Divorce could my husband use these e-mails against me, and take the children from me?

In a word, Yes, he can use those as evidence provided his attorney properly sets them up as evidence to be admitted. Does that mean you will lose your children? Not necessarily. That is a more complex issue for this venue. You need to consult with an attorney if you are going to pursue your plans or if your husband decides to file for divorce.
