Legal Question in Family Law in Texas

Custody Battle

My boyfriend is in a full custody battle with his ex who is no longer attending school. My boyfriend is currently attending school and I'm currently attending college. The mom has refused to come back home and remains with her boyfriend 8 hours away from the baby. But acts like she was neglected there. My question being, If she got kicked out of the house because she refused to come back and be a mother, And there's a police report of her refusal to come back , and I live on a University, 2 months pregnant, and I'm obviously dating her baby's father, Can my baby come in the way of the custody battle. If she uses the fact that I'm dating the father, I'm pregnant, and the family has ''replaced'' her in the custody battle, can that interfere with anything??

I hope some of all of my questions can be answered or adviced.

Stella

Re: Custody Battle

If your boyfriend is in a full custody battle, then I presume he has a lawyer, as this is an ongoing legal proceeding that usually is beyond the capability of a layman.

The dad's relationship with you is relevant to the extent of his living arrangements, and living environment for his baby. It affects his financial, emotional and day-to-day condition. Beyond that I am not sure what your question is -- in all custody matters, the court looks to see what is the best interest of the baby. Usually a parent is superior to grandparents, but that part of your question is somewhat vague.
