Legal Question in Family Law in Texas
I am going through a custody battle right now for my 5yr old son. Last yr in March 2009 I had a hysterectomy which caused me to be in recovery for almost 6 weeks. At this time I gave my son to my ex (his father) to look after him. After my recovery I finished school and then moved to a different city only 15 miles away. In turn my ex and I agreed that our son could stay with him for the next school year until June 1st of 2010, which in turn I would get him back. But in Jan. of 2010 my ex took me by surprise and threw a full custody suit against me, claiming I abandoned my son. We go back to court in May of 2010 and the judge will decide. I wanted to know what chance do I have on getting my son back. I see my son EVERY weekend from Fri at 1pm till Sun 6pm. I have not missed a weekend and I still provide for him. So I also didnt understand how he says I abandoned him.

If you have a decent lawyer, your chances should be good. You'll want to get a social study done (the Judge may order it without anyonen even asking).
Frankly, I think it's a shame that your ex-husband is taking advantage of your illness this way.
