Legal Question in Family Law in Texas

There was a custody case several years ago and both parties were represented by counsel. The case has been closed for a few years now.

If both parties agree to a modification, and want to file with the court, must we go through the counsel used in the case?

When does representation end? When the case is closed?

No, there is no requirement that you use the same attorneys. Technically, you could even represent yourselves, though I'd be very careful doing that. If the modification is agreed, you should be able to find affordable representation without much problem. It's when there's no agreement (and sometimes not even any clear idea what would actually work for either parent or the kids) that things get so expensive and time-consuming. As long as your modification isn't something that's likely to cause the court concern that it might not be the best thing for the kids, things should go pretty smoothly. Good luck!
