custody and name change

My daugter currently has her fathers last name, we never got married and have been split up for over 2years now. we got child support set up but never followed thru with anything else because we just made an agreement between the 2 of us. Since then he has barely seen her, he moved to another state at christmas 2008 and has only called her once since. if he is paying child support but doesnt help out any other ways can i still change her last name to mine so it will lower confusion for her when she starts school

Child support has nothing to do with it. It takes the permission of both parents to change a child's name.
