custody of the child

If I was divorced when I delivered the child,and my ex husband appears on her birth certificate who has the custody for the child?Can he get the custody if he files for it without my permission?

Your permission isn't necessary to file. If he is the father, he can start the legal proceedings. Maybe you should be the one to start. Good Luck.
