Who gets custody 2

If a child doesnt have a father listed on their birth certificate, but knows who their father is. If the mother dies, would the biological father or the husband (stepdad) get custody. The biological father has never paid child support but she does visit with his family once a year. My husband has taken care of her since she was 10 months old. If i dont want my two children seperated and want my husband to get custody, is this something i can put in a will

Typically, if the mother dies and wants the step-father to obtain custody of the child, the biological father's parental rights will need to be terminated by a court order.
