Custody of a child my nephew

Hello I needed help, I have had my nephew since he was 6months, I have returned him to his mother a few times and she has sent him back, he is now five years old and at the age of 22 months I requested for his mother to sign a temporary guardianship of him over to me and a friend, she did since then I have had him in school, had his medical papers sent to me in my name because he receives state medical services. He is developmentaly delayed that is why he has been in school since he was three, now after all this time she says she wants him back, so I thought I had no right to him and sent him back to her she was suppose to come big him up from my mothers house a month and half ago, and she still hasnt showed up. Then to find out, I am being told that she needs me to release him by signing some papers I guess to be able to get benefits for him and for her to take him back. If this is the case does this mean by law after all this time I am considered his true guardian. if so then I will not release him to her. What should I do. I am not rich and do not have thousands of dollars to go to work.

Please go talk with an experienced family lawyer. First, she does not seem very stable, and second you may have standing to obtain court-ordered conservatorship of the child. Many attorneys will take a payment plan if necessary. Find out what all of the options are, before returning this child.
