Legal Question in Family Law in Texas

custody and child support

I have physical custody of my 2 1/2 yr old daughter. The father and I were never married. He refuses to help with her expenses unless we are ''together''. I cannot afford an atty. He may be a loser, but I want her to have a relationship with him and be able to visit him, but I am afraid he may try to keep her. If we both sign a notarized agreement that I have custody, will that stand up in court and will the police acknowledge it should he try to keep her? I live in Denton County, Texas. Can someone tell me what forms I need to file to petition the court for custody and child support? I called the court clerk and she was no help. I have a case with the Atty Gen ofc (applied in Feb2006)but won't go to court until Mar/Apr 2007.I don't qualify for any government assistance and have no money left after rent, utilities, and daycare. HELP PLEASE~!!

Re: custody and child support

The Texas Attorney General's office will set up child support and visitation.

They are slow, but they are free.

Good luck!

You said that you don't qualify for assistance -- have you contacted North Texas Legal Services? Or Texas Weslayan Law School clinic program?

The notarized statement is not going to solve your problem. If you have ZERO resources and these agencies cannot help you -- go to the law library in Denton and ask the librarian to show you the form books -- there are even packaged forms.

There are attorneys that will accept payment plans.
