The court is obligated to consider the best interest of the children when making a determination as to conservatorship.

There are many factors specific to each case which could influence that decision: alcohol, drugs, family violence, criminal history, age of the children, conduct of the children when with each parent, conduct of the parent when with the children, income, stability, support group of family and friends, living arrangements, psych status of the parties, etc.
