Legal Question in Family Law in Texas

can we get custody

We have two children that live with their mother in Texas. She has done questionable things sence the devorce. She has moved 4 times in three years, lived with two different men, with the children. She has been neglectful in the childrens medical care, one of our sons has two teeth so badly rotten that one has to be pulled and the other needs to be surgically removed. the rest of his mouth is also in very bad shape. we told her this when we took them to the dentist two years ago, after we learned she has not taken them. We pay the health and dental insurance for the children so there is no reason for this. We would have had the work done except that we live in a different state and only see the boys in the summer.

Based on the limited information you provided, it does not sound like SC will have jurisdiction to do anything and that jurisdiction will likely lie in Texas. You should consult an experienced family law attorney in Texas to discuss your options there.

If the decree issued from a Texas court, contact an attorney in the area of that county. Your information sounds damaging, however, there are many factors that the court will consider. Some of those factors include age of the children, alcohol and drug use, if the children are older, their wishes. The court is bound to make a decision in the best interest of the children. After an attorney has an opportunity to review all the facts, then he/she will be better able to advise you.
