Legal Question in Family Law in Texas

Custody after Death of Parent

My Husbands Ex-Wife is expected to pass away from stage 4 cancer in the very near future. In the meanwhile my husband is stationed in Iraq and would like to me to obtain custody of his children from her family after she passes away. It is not expected to be amicable or to go off without a hitch. What legals forms should my husband and I obtain before the he is to go back from R & R that the constables would need to see to assist with having the children picked up.

You're going to have to have an order from the Court. Better get started, it takes time and I think you going to have to hire an attorney.

My guess is that your husband is going to end up in a contested custody contest with his ex's family. This is not something you can just get some forms for. He is going to need a good family law attorney.

Feel free to call the office or have him email with more details if he would like to discuss this further.
