Legal Question in Family Law in Texas
custody to disable parent
hsbd is disabled d/t kidney disease, back pain, on a lot of meds. Also very controlling and vengeful. Plans to obtain custody of our 5 yr old son w/me having standard Texas visitation. he has overslept on school days 2x's and dec'l to bring him in late and compares this to the 4 times that i have had to keep him home sick--2 x's of which i have a doctor's note for. He has also intimidated the teachers at school with demanding behavior. He has never taken our son to the dr. or dentist, given him a bath up until 6 months ago, cut his nails, taken him to any children's b'day parties, etc. he plays violent video games in front of him, has guns in the home that are not locked up, is usually under the infulence of pain meds. he also maintains control of all of our finances and i left the family home, but my son is on my lease. he harasses me constantly and one day called me 8 times. what are the chances of him getting primary custody?

Re: custody to disable parent
It is impossible to speculate on these matters. His lawyer will present the case in a different light. You need to get a lawyer so that when your case is presented it is in YOUR best light. There needs to be a temporary orders hearing to decide temporary conservatorship. The sooner you do this the better, because your husband is establishing a new status quo for the judge to consider.
