Custody and drinking

My question is: Is there a Texas State Law that says a custodial parent can not have a drink while in possession of their child or 24 hours before that child returns? I have filed for divorce and that is what my husband is telling me - that I cant even have a glass of wine at home or a drink out at dinner and that it is state law.

Ask your H to give you a copy of that law and ask for a copy of his law degree.

It's not written anywhere I can find.

However, I often include such a paragraph in a final decree of divorce. It is usually mutual.

If drinking is an issue, then I usually recommend that you stop drinking so that the issue is "off the table."
