Legal Question in Family Law in Texas
Custody help fast
My daughters(ages 11yr and 13 yrs)went to see their dad this past summer. He now lives in Virgina with a woman. This is the first time they have ever spent more than a weekend with him in the 7 yrs we have been divorced. One of my daughters (the 11yr old) asked if she could stay. After much debate I decided she could but only until Dec. and she is to come home. Well, now, he won't send her home. He says she is happy there and wants to stay. I could go on and on about the history with this guy but I will run out of space. He has never been real stable mentally or financially. He is Bipolar and doesn't take his meds. And works min.wage jobs. He seemed pretty stable at the time I let her stay. He and his girlfriend have a baby due in Jan. Anyway. My questions are how do I get her back? I am going to file contempt of court charges against him and motion for enforcement. What else can I do. If I go up and get her from school, will they let me have her? Where do I stand. If she decides she wants to live with him I said I would do it legally through the courts. Until then she needs to be returned to me.

You have a complicated interstate custody matter. I presume you have a lawyer assisting you with this. Follow your lawyer's advice. If you don't have a lawyer, you really need one very soon.
