Legal Question in Family Law in Texas
Custody for father
I have been divorced close to 7 years. My son of 9 has lived with his mother from the time of seperation. I pay child support a have within 150 miles visitation. I have a good relationship with my ex and frequently am able to see my son for more days than outlined in the dicorce. 6 months ago she remarried. I have not but have been living with my girfriend for 3 years. After 2 or 3 months my ex came to me explaining that she will be getting a divorce from her husband. She found that he was stealing from my son and had stolen from her and her mother. This theft was to support a drug habbit that he has. She stated that he would not leave the house, when asked, and she was afraid that he might snap. She contacted his parole officer, he had been in jail for 2 year prior, and he was arrested for parole violation. To make a long story short she will be getting back with him after his term in jail is done at the end of October. Would I have any chance of getting primary custody of my son? I feel this guy will suck the life out of my ex and intern my son. Thanks!

Re: Custody for father
You need a change of circumstance to change custody.
You might have the necessary grounds.
You need need to sit down with a lawyer and talk to an attorney in detail about all the facts in your case.
No attorney can answer you with the brief facts stated in your email.
Good luck!
Call me if your case is in the Harris County/Fort Bend County counties. I refer to other attorneys for other counties. I'll be glad to give you a referral if you call me.
