Legal Question in Family Law in Texas

custody

i have a friend who has a child with a man. the guy was convicted of dwi with a child. the guy also physically and mentally abuses her. the man doesnt have a job and lives with his mother. he can barely take care of himself and is unable to take care of the child.he will not let her have the baby. what are her options on getting the baby away from him?

She needs to get a lawyer and file a Petition Affecting the Parent-Child Relationship, and be prepared to establish the factors you have set out, to obtain primary custody of her child.

This is more complicated than it seems and some of it depends on how long the child has been with the father and whether or not there is a Court Order in place. Based on what you have written, there are some questions which need to be answered prior to providing an adequate avenue to proceed down. First, are these two people married? Second, does your friend live with the father? Third, how old is the child? Fourth, is the child a male or female?
