Legal Question in Family Law in Texas

custody

I have a friend who has joint custody of his daughter... he is currently deployed to Iraq.. his exgf gave her parental rights to her new exbf. This new exbf now is caring for his daughter and is trying to get custody claiming step parent rights but he was never actually married to the woman. He does have a daughter with this woman as well. Can he take custody from the biological father. The biological father does want his daughter.
